Maryland jails will no longer house federal immigration detainees and federal immigration agents’ access to state databases will be limited, following actions Tuesday by state lawmakers.

The Maryland General Assembly voted to overturn two vetoes from Gov. Larry Hogan of the bills, meaning the measures will become law.

As lawmakers worked through their second day of a special legislative session, they also advanced a new set of boundary lines for the state’s eight congressional districts, the primary purpose of their return to Annapolis this week.

The votes to overturn Hogan’s in the House of Delegates and Senate represent a victory for immigrant advocates, who have argued that immigrants, legal or otherwise, live and work in fear of being picked up by authorities and locked up for minor infractions. And they’ve questioned the ethics of profiting off jailing people.

“Immigrants have contributed, contributed so deeply to every single facet of our society in Maryland,” said Cathryn Paul, public policy manager for the immigrant advocacy group CASA.

Paul said that a particular concern is agents from U.S. Immigration and Customs Enforcement having unfettered access to driver’s license records and photos.

“[ICE] can just dip into the [Motor Vehicle Administration] database and search through not just the private information of immigrant drivers, but the private information of anyone who has a driver’s license, without any sort of probable cause or reason for doing so,” she said.

Sen. William C. Smith Jr. said federal law enforcement agents still can access the driver’s license databases without a warrant if it’s part of a criminal investigation. The databases now will be off-limits only for immigration cases.

Smith, a Montgomery County Democrat who chairs the Senate’s Judicial Proceedings Committee, noted that Maryland allows immigrants who lack legal status to obtain driver’s licenses.

Opponents of the bill argued that the country’s immigration system is broken, but state-level action is not the solution. Limiting access to government records will “potentially make our communities much less safe,” said Sen. Justin Ready, a Carroll County Republican.

The other measure, called the “Dignity Not Detention Act,” puts an end to deals where local jails make money by housing federal immigration detainees.

Some counties have dropped their jail contracts under pressure from residents who oppose them. Worcester County had the largest federal detainee program, and officials there said the General Assembly’s action would lead to more than two dozen workers at the jail being laid off.

Lawmakers who support the programs said that immigration detainees are going to be held in jail regardless, so it might as well be in Maryland, rather than sending local detainees to other states. Several Republican lawmakers spoke in favor of the programs, including Del. Haven Shoemaker of Carroll County, who said that eliminating them makes Maryland “essentially a sanctuary state.”

Del. David Moon, an opponent of the jail programs, said that the vast majority of people detained have no criminal record and shouldn’t be behind bars.

“We’ve got to stop the xenophobia. We’ve got to make Maryland a sanctuary from this foolishness and xenophobia,” said Moon, a Montgomery County Democrat.

Turning their attention to the special legislative session’s primary task, the House of Delegates approved a new map largely along party lines Tuesday night, sending the measure to the state Senate for consideration.

The map, which enjoys support from Democrats but draws disdain from Republicans, likely would keep seven of the state’s eight congressional seats in the hands of Democrats.

Supporters of the maps say they’re an improvement over the current districts — which snake across the state in convoluted ways — while keeping “communities of interest” together and ensuring that at least two districts are likely to elect a person of color to Congress. Even with the new lines, most Marylanders would remain in the same district they’re currently in, proponents say.

One of the most notable features of the map is stretching the Eastern Shore-based 1st Congressional District across the Bay Bridge to pick up much of central Anne Arundel County. The district is currently represented by U.S. Rep. Andy Harris, a Republican.

“My bowel movements are more compact and contiguous than these districts,” said Del. Robin Grammer, a Baltimore County Republican who voted against the map.

Del. Matt Morgan noted that Maryland’s congressional delegation has gone over the years from an even 4-4 split between Democrats and Republicans to today’s seven Democrats and one Republican. While the Southern Maryland Republican acknowledged that there are significantly more registered Democrats than Republicans, “it’s not 7-to-1.”

Republican leader Del. Jason Buckel of Western Maryland proposed an amendment that would have deleted the Democrat-backed map and substituted in the map from a commission appointed by Hogan. It was rejected by a vote of 43-93.

Hogan’s commission was comprised of a mix of Democrats, Republicans and independents. The commission’s recommended map has more neatly drawn districts that would give Republicans a chance to win one or two more seats in Congress.

Hogan, meanwhile, continued a social media campaign blasting lawmakers. Hogan’s political group, An America United, posted a video portraying him as “fighting for the will of the people” against the “extreme and radical” districts pushed by Democrats.

The Republican governor has threatened to veto the map that’s moving forward in the General Assembly, but Democrats hold such large majorities in the House and Senate that they can override such a veto.
